Hello All,

Its been awhile since I posted something fun. On 6/15/06 I had my car parked down the block from my friends house. Were I was parked the sign said "Residents parking permit requried" Non-resident 4 hour limit. My friend said they barely give out tickets during the weekend in the first spot that I had Tuesday night. Wed. night I moved my car into a spot close to his house and he said parking at this spot they should not give me a ticket. So I left my car, went to work and came back for this suprise.

Not only was my Car booted, but my Rim was stratched up. Those bastards.

1) I'm pissed there is a boot on my car
2) I also received a ticket for Permit parking Violation for $45.00
3) There is a $130.00 Fee to have the boot taken off
4) My rim is messed up, scratched by the boot being put on in the first place.

So here's what I do. I pay the $130.00 Then I went to the police station to file a claim for damage of property. When I spoke with the boot people the women said if you fight the ticket and tell them that your car was damaged they would pay you back the $130.00

Next month i'm going to NJ Court. I'm going to fight the ticket for many reasons.

1) there was no signs that said if you violate the parking that they would hit you off with a double whammy by giving you both a ticket and botting your car on the same day.
2) They damaged my rim in the process.
3) Its called a Tort (Trespass to Chattel) Personal Propetry got damaged in there care and the vicitim (Me is stuck with damages by there service)

So next month I'm going to court. Its going to be myself. Defending my HHR vs the City of Hoboken, NJ

Good luck. I hope you get the $130 back plus the cost to repair and/or replace your rim.

Thats what i'm hoping for. But I did get Tire and Rim coverage with my car when I bought it. So i'm not sure how that works out. But I need to take this to court first before I make a claim against my coverage

Oh I also forgot to mention that A month after I bought my HHR I received a no Standing/sitting ticket. That ticket was a 90.00 fine and I won that ticket. So that care was NYC VS SIHHR and I won. So Jersey is going down next.

Can't say I blame you one bit. While I understand the parking violation ticket, I find it absurd that they booted the car for a single violation. And then to damage your rim like they did...just sucks. Good luck with your court fight...I hope you beat them...but good and get your rim replaced. Let us know how it all turns out.

BTW...did you know the "boot" originated in Denver in 1953?

I thought boots were only used when someone owed an absurd amount of delinquent tickets? Guess it is simply another compliance tool used by the agents of social control at their whim.......:eek:

Sorry to see all this go down. Good luck fighting the system. You did well VS NYC, so why not NJ!

I spoke with my dealership's financial officer, the one who explains all the finances to you and tries to upsell you on these policies. She said "pothole". "You hit a pothole".
That is how it works. Curbs, no-go. And I assume the same would be true for a boot since it is not necessarily a "road hazard"

So you see, my road hazard was a pothole. I think you had a bad time with one too. Didn't you?;)

:roll: I`d say at the very least , your friend is to blame (and you for falling for that story) . You knew there was a chance of receiving a ticket, it was posted. your friend convinced you otherwise. send him your bill, not Mr. John Q. Public(us).!!!:nono:

I cant make my best friend pay for something that he gave me advice on. However keep in mind I still bared the risk and parked there and John Q Public decided to boot my car and damanged it in the process. Not my friend. I'm going to fight the whole parking system.

If this is an appartment complex with private parking area then they can be held responsible for the damage caused. I was parked at a friends house for dinner and my car got towed (when i was in high school) and the tow company damaged the drivers side door when using a slimjim to get in and release the emergency brake. The appartment complex had to pay to repair it because they contracted with the towing company to to cars. I was only there for about 2 hours.

In the town I was in, appartment complexes contracted with tow companies to drive through the parking lot every few hours and tow any cars that were not residents. My wife even got towed from in front of her appartment because it was parked too close to the front door while we were unloading the groceries. They are brutal there.

I`m guessing you don`t really know who JQP is!! Sounds like one of those Jay Leno (j-walking) type answers. When you get to court, let your lawyer do the talking, ( don`t get a J Q Public defender).

I went to Court Today against the City of Hoboken, NJ. I had to pay the stupid 45.00 parking permit violation and I was told that I now must file a claim against Hudson County, NJ for the damages the City of Hoboken Parking Dept for the installation of the Boot that scratched my Rim. I will let you know when I have that case whenever that will be.

Sorry to hear that SIHHR...that sucks. The saga continues...and in the meantime you've got damaged rims. Please keep us updated.

SI, I hope you win on the damage charges, but if you would have used common sense, this wouldn't be an issue. I guess when you see a permit parking sign, you will remember your headache!
