Sadly, he was... he'd been riding my bumper for about 2 miles. I let him go ahead and since he slowed down to a crawl I swung by to pass, he downshifts and guns it, so did I, he lost. 
Mind you this was before the tune too. (I'd post in War Stories but I don't like to gloat, too many eyes watching lol).
