Unhappy Atlantic City Depressed Way HHR SS Transmission Problem

My 2009 Chevy HHR SS with "at the time" less then 90,000 miles on it, blew out 5th gear on the Atlantic City Expressway. Leading up to the transmissions catastrophic failure, it had popped out of 5th gear a few times minutes before hand. Chevy's warranty would not cover it "of course". So I found a mechanic that replaced the transmission with a used one. It was fine for a few months but now that transmission is popping out of 5th gear too! My mechanic told me that he rebuilt 5th gear on that transmission and was not sure what the problem could be. Now he wants to replace the linkage as that wasn't replaced when the transmission was installed. My question is could that really be the problem? Also is there any GM mechanics that aren't dealerships around me in South Jersey that could help? I love the car and own it outright and would hate to trash it due to this issue.

Let's start. You had a used trans put in. How did this mechanic know to replace 5th gear before it was installed ? 5th gear is a gear also.
Sorry I can't find an exploded view of this trans. Worn clutch dogs for the synchro sliders can make a trans pop out of gear in other units.
Maybe someone on this forum could dig up pictures. That would help.

There is no real linkage. Just 2 shift cables between the shifter and transmission.

I agree that the clutch dogs are probably the culprit but could it be a bent bracket or worn cables? He seems convinced, but I'm thinking it's more of my money being wasted. Also, if it is the clutch dog gear is "chewed up" haha, does the transmission have to be pulled to replace the 5th gear clutch dog?

if the repair was not too long ago maybe the shop will stand behind it or give you a break
