I'd agree, But an HHR may have not spun out in the first place. He's a lucky guy , No matter what he was driving ..

And why is that? I doubt a 2004 Malibu is much different...

There is a reason that the malibu gets safety awards. It's main structure in built more like a cage, whereas our HHRs are more related to a van or a breadbox. Not much structural integrity built into the roof of the HHR.

You're talking about the new Malibu. He was in a 2004, so it was the previous generation.
