As of today that is correct. However, If you read Tom's post from Crate Engine Depot which he posted on another forum, he says that when they ship the back orders this week or next they will be '09 compatible:

I should have kits to send out next week, I should have enough for every one who has one on order from CED.
Plus an added bonus, we should also be 09 certified and good to go for all 09 models.
I will post up more as info comes in.

So in other words the part #s are the same, is the flash the same as well, or will that be the only difference? So I can order from CED now and it will ship when they get them in? Just want to clarify all this, the "difference" or gap btwn the 08/09s is really messing with my head! lol I see it as they just had to wait for the 09s to be certified, but otherwise everything is exactly the same, parts, flash, etc... If this is the case then I will probably get mine on order now so I can get it ASAP!

OK, clear! Just to make sure, the part # for the 09 will be the same as the 09, so if I show up with a 08 kit they won't know the difference, or wait and order a 09 kit?

'09 kit vs '08 kit
The part number for the '08 and '09 kit are the same. rumor is that if you don't already have the kit in hand you will get a kit that is for '07 thru '09's. The differences are the instruction with the updated calibration numbers and the emission certification sticker with the update EO#

Yes, I believe he confirmed that in the other thread. Any of them sold after the backorder would be updated.
