That sucks. Kudos for not creaming the jaywalker (who I bet didn't even stop to see if you were okay). I live in a college town and I have to suppress the urge to act out the movie Death Race 2000 everyday. Of course the responsible adult in me is relieved that no one was hurt - it is only sheet metal after all...

You stop and the guy behind you runs into you, he was tailgating plain and simple. he was at fault and his insurance should pay. I would have written him up for following too close.

Update: he called me back and is going to take care of paying for the damage. And, he wasn't tailgating, he just wasn't paying attention. i heard the screeches of the tires about 5 seconds after i had come to a complete stop. He had PLENTY of time and space to stop had he been watching where he was going. that's why he doesn't want to go through his insurance company. I wouldn't want to tell my insurance company either that i wasn't paying attention. I did file an accident report just in case he was going to try and screw me over.

You are correct, in fact NO ONE stopped except the guy that hit me.

I am glad that you did a report, Just tell your Insurance Company that he is going to pay so it does not count on your Ins. I am glad that he is an Up standing driver and is offering to pay. Good luck Still waiting for the pic's
