They can't make it a recall because GM does not have a fix for this...

My fathers will not let him put it in gear because you must depress the brake peddle to do so and the peddle will not depress.

They have almost drove through two intersections due to the brake's being non existent.

My Mother almost backed into the neighbors parked cars due to brakes being non existent when backing out of their driveway.

This is the third time it's been to the dealer. The first time they said they fixed it. The second time they kept it thirteen days and they decided to replace the Brake booster. This is the third attempt to solve the problem.

I know this is an SS thread but when you go to tap the breaks and nothing is there do you hear a grinding noise (what I call it) in the rear? This will be the 3rd time I've heard a horrible noise in the rear when I go to stop on dirt by the way in my 07. I'm going turtle speed when this happens...I'm coming out of a driveway so I'm not stopping fast it is slow. When I mentioned it to the service dept he said he "thought" it was my anti-locks coming on but never checked. I've heard that sound before in my other vehicles and that is not the same sound.

Well after the 3rd attempt your car would be a good lemon law car because that is not safe. I don't care if it happens with all the ss cars I would not feel safe having my 2 & 7 year old in the car with me.

I just returned from 2 weeks vacation and wanted to see if my SS suffered from this. Started it, immediately put in Reverse and backed out of the garage, the brakes were normal. Is this just an Auto issue? I think my SS is a late 2008 build.

I assume they would start with the reprogramming specified in the TSB. If I were having similar problems I would leave it overnight so they could experience it. I just know that if anything happens because of it there are huge liability issues. And if someone were permanently disabled or killed, wouldn't you feel like an a$$ for the rest of your life knowing that you knew you were on the road without brakes and could have done something to fix it? Not trying to be a drama queen, but I wouldn't want to deal with that kind of guilt if anything bad happened, to a complete stranger, or someone in your family. You could also be successfully sued for wrongful death or long-term disability care (beyond your insurance limits). If they could show that you knew you had a brake problem and continued to drive, you and GM could be liable. GM would then say that if a brake problem were discovered, any reasonable person would get it corrected ASAP. If you didn't give them an opportunity to correct the safety defect you discovered, you could be held solely liable for knowingly operating an unsafe vehicle on a public roadway.

Lemon laws in most states allow you to return the vehicle if a safety issue is not corrected on the first attempt (instead of usually 3 attempts for non-safety issues). Get a loaner while it's at the dealer, start with the TSB reprogramming. If it still has the brake issue after the reprogramming then I guess they can do a full diagnosis on the brake system or they can take the vehicle back and you can buy an '09 instead. That would cost them money so it would be way better for them in every way to take whatever steps are necessary to fix the brakes.

I don't fully understand the pressure thing going on, but it seems like people are saying that the brake system pressure is shared with something else (turbo boost?) Who knows, this issue could conceivably be related to the same leak that has been limiting boost pressure under acceleration. (Although noticeable for acceleration is a big leak, and overnight brake pressure could be a much smaller leak. That's *if* I understand correctly which systems are linked.)

I love my SS, but I wouldn't drive it without brakes, even if I had to wait an entire month for parts.

Glad you're bringing it in. I really want to hear whether they can resolve it, and if they have to do anything besides reprogramming to do it.
