Start up brake issue
NHTSA persuades GM to make a recall (voluntary recall) or requires GM to make a recall (mandatory recall). This is a regulatory decision. "Recall defective vehicles from service." Fixing said issue is something that the manufacturer must do to alleviate the legal exposure to recalling defective vehicles from service (as in, fix it or compensate us for our lost benefit).

This is independent of whether a fix exists. Otherwise, what they'd be saying is that... so long as a fix doesn't exist, there is no need to address the safety issue.

When is a recall necessary?
- When a motor vehicle or item of motor vehicle equipment (including tires) does not comply with a Federal Motor Vehicle Safety Standard.
- When there is a safety-related defect in the vehicle or equipment.
My parents are currently in the process of doing the Lemon Law on their 2008 HHR SS. It has the "Brick For A Brake Peddle" problem. They have taken to the deal four or five times. Today they dropped it off for a GM rep. to test drive it. Her final decision was, and I quote, "We can not fix it."

My wife wrecked our HHR SS friday night. It was towed to teh body shop at the dealership it was purchased from they pulled it in monday morning and freaked out thinking that the Abs or something was damaged. when they called to tell me that i said that is the problem with the car and they said they would check into it for me so now he is on the phone with Gm telling them how it was and that he almost wrecked the car pulling it in to the shop and they were going to check into more and they were supposed to get a 09 in and they wanted to see if same problem occurs and they will then figure out what can be done to correct it
Some pick up vaccume faster than others and some people react to this more than other.
The second tag on you dash when you bought this explains about low vacume and how the ABS works to try to help it.
Best for you to have the dealer talk to GM and find when they expect the add on Vaccume pump is going to be ready to fix the problem.
Your going to have to learn to live with this till they get the TSB fix done. Or look for a buy back but getting an 09 will not fix it unless it is a 5 speed.
The car just drives like it has lost the power brakes till the vaccume builds up a little. The car will stop but you have to step on it harder.
They do have a TSB that will improve it a little but the TSB to fix it is still in the works. I expect we will hear about it by the end of the year. GM knows they need to add this to all 08 and 09 automatic SS.
I hope they find a fix for this soon because I took mine into the dealer and they did the fix where they program the ABS to help compensate and I find that even now with my foot firmly on the brakes and stopped the car jerks as if it wants to move because of the ABS. It used to be just when it was left overnight but now it seems to happen all the time and I should not have to let the car run idle for a couple mins everytime I want to drive. I should have gotten the manual tranny. I only got the auto so my wife could drive it if she ever needed to.
