NOW im mad went to the dealer this morning and the body shop looked at belle he looked at me and said its not the door its the frame and proceeded to show me the cracking body filler down the side of the door frame and the overspray around the gas door he said the car has been hit in the rear quarter and has been repaired thats why the door is not lining up and shutting right. then he tells me if it has been hit they wont honor the warranty BS . i had the carfax pulled when i bought it and it comes up clean so the accident was never reported . i talked to the sales manager and the salesman i purchased the car from and they said they would give me a rental wed and have belle fixed ?. i dont know if i should say ok or what options i have at this point i dont like the idea that this was wrecked and NOONE knows how bad its from ny then sold in oh then to wv then to me it was a rental for about 6 months any help or advice here would be very appriciated guys

WOW, an 09' with the repairs not reported and it's already coming apart! We had a lady locally buy an 08' Toyota with a clear car fax report! There had been major body repairs that were unreported! She's demanding a replacement vehicle as she claims mis-representation! This is something you might seriously consider (contact your local news station)! We would also recommend halting repairs to your HHR as your consider "ALL" options!

First step is to obtain legal representation, this is probably going to lead to civil litigation. Did the dealer provide you with CarFax or did you do it yourself? I have a sinking feeling that since your vehicle originated in NY and then bounced through two other states, you may be driving a vehicle that has been salvaged. It is common practice to take a vehicle with a salvage title and register it in another state to "wash" the title, thus removing the salvage branding and increasing the value as a used car. Contact the department of motor vehicles in New York, explain your situation and have them check the VIN to see if a salvage title was issued. Also contact the DMV's in Ohio and West Virginia, have them run the VIN and see if it was branded as a salvaged vehicle when a title in their state was applied for. As far as having it fixed, I would approach that with trepidation, any repairs should be only done with factory new parts...and even then I'd be inclined to walk away.

This is your best course IMO. Tell the dealership you want your money back.

yes the work has been stopped. the carfax was from the dealer and was clean when i saw it . the sales manager and the salesman both said they will honor the warranty they are giving me a rental while they look at belle if i decide to go the repair route im uploading pics now
