just out of curriosity, did you have anything plugged into the cigarette lighter/ 12 accessory outlet when this happened???

reason i ask, and for reference, in my 09 i had this problem:

GM called today and advised that due to the nature of the claim and the year of the vehicle, they are now sending it onto another body within GM called the Central Claims Dept.

The Central Claims Dept. advised that they would evaluate the findings and determine how they will move forward in terms of damage coverage, this could take from 30-120 days (thats right kids, 1 to 3 months!!!) to process, at which point they might come back and determine that the vehicle functioned as intended and might pay nothing.

The Central Claims Dept. is supposed to contact me within 7-10 days for a case update.

Since the car is a 2009, I am wondering if they are stalling to the point that the car is out of warranty...

Feeling a little helpless.

One thing is for certain, when this is all said and done and the car is repaired, there will be a 2009 SS for sale with less than 15k miles on the clock...

Better to just turn it in on insurance before a lawyer.

You will spend more on a legal case than anyother option.

As for selling it? You will take a bigger hit in depreciation selling it at this point. You had a rare thing happen that will not repeat and you may as well get the good out of the vehicle.

Lawyer and selling it = major loss in money.

I know things are not fair but life is not always fair. Sometimes you just have to take a step back and take the best option even if it is not one you like.

I would let GM do what they need to do. The car was presented to them prior to the warranty going out so there is no danger there. I would just keep pressing them to do what they need to do and I expect they will fix it as long as there are not cazy thing showing in your black box.

I get tired of everyone always saying they are getting a lawyer but few do and most that do get taken by the lawyers.

I suspect GM is working this carefully as they could put them selves in a bad place for many legal cases in the future. Once a company does something it sets a presedent and they need to find out what they can do. Often it is the lawyers that cause companies from doing what they would or should do to solve a customer problem.

I see it at my own company. We get deals were we want to do something but often can't because it can legally backfire on us even in cases where the customer is at fault and tries to blame us.

Was it just the airbag on the drivers side that went off or both sides? If the side impact protection system was triggered would it not set off both side impact airbags or can it just set off one side or the other?

I have followed this thread from the start with interest. I have to agree with those about retaining a lawyer. Consult with one first. If they feel you have a strong case then why not? Damages,loss of use and attorney fees is what you are looking for. If you decide to go the insurance route and have it repaired, then sell it, do you disclose to the buyer about this problem? Could you be held liable if the new owner has the same problem? I would want a lawyer on my team just in case. My 2 cents.

Talk to the lawyer and see if it worth pursuing after you talk with GM and decide they are unwilling to help. Also, call the department of transportation and ask about filling a claim against GM that states the nature of airbag deployment. They are LIABLE for the production and design of the vehicle, and if you all need proof of liability issues look to aviation litigation suits. The part DID not work as intended if the car DID NOT roll over, which means that they have a design flaw somewhere. They have a hundred years of knowing road conditions and designing cars. If they did not want the car to go fast, then why produce videos and advertisements on its abilities on the track. It is their fault no matter how they swing it. It all depends on how you approach the situation. Remember DO NOT get mad, sitck to you points, be honest and up front, and work with them until it is time to get a lawyer. Do not through the lawyer card out TOO early. Show a willingness to work with them first, and that will play well in court if it goes that far. At that point, if they tell you they want insurance to pay for it; ask for that in writting and send it to you insurance company cause their lawyers will love that :)

As far as trade in value vs pay off.... I paid too much for mine at purchase but now I am way under trade in value since I got that 0% financing. I dont have many miles on it so that helps alot.

after reading all this...there is noooo way i would sit around an wait for GM to address this at their leisure - see a lawyer!!

a consultation is free - wont cost you a dime...if its an experienced attorney with a good reputation you have absolutely nothing to lose but a little time and since GM says months - you have that.

sometimes just a letter head from an attorney will straighten things out and get the ball rolling alot faster

professional advice is what you need -the naysayers about lawyers probably have never hired one and seen what they can do - they can do a lot and if you have a case you will probably settle out of court anyway and cover all expenses

or you can wait and see - just my .02
