Whatever the "truth" is will never be known to the public or the members of this forum. It will take 3 or 4 years to get to court and there will be a civil suit even if the truck driver does not get a citation or criminal charges.
Typical cost of a fatal accident to a trucking company is about 2 million dollars....regardless of fault. Lawyers will come out of the woodwork, so to speak, because trucking companys have deep pockets.

Ok. Wow! Since I was the one who originally posted this, I'll tell you what I was thinking.
I was thinking how poorly this vehicle performed in this particular crash, and that if it had been me, my daughter would have been sitting in the back seat, and that if maybe the big trucks had bumpers that lined up with those on regular cars, the result might have been different.

Even though this crash proved to be fatal, there have been many members here on the forum that have gotten into an accident with their HHR and walked away unharmed. I remember a couple head-on crashes posted here on this forum a while back where the HHR is totalled, but the passengers make it out okay. The HHR is rated "Good" for the Frontal Crash Test. Overall, the HHR is a pretty safe vehicle. When you're dealing with a Semi vs. Car crash, the semi always wins and the car usually suffers the brunt of the damage.

Big trucks and small cars just don't work no matter what they are. IF the bumpers had matched I would not be soure the results would have been much better.
Pure physics are just too hard to over come.
This truck would have even folded a full size full frame car up pretty well.
Over all the HHR is a very safe vehicle but when this much mass is involved there is little one can do.

80,000 lbs VS 4,000lbs. the outcome is terrible no matter what kind of car it is.
We had an incident 2 years ago where a car stalled on the highway and cut off a tanker truck causing it to crash and explode. They charged the driver and he was just recently acquitted at trial.
