GM stage kit for 08 why not for 09 worked

one can install 08 kit on a 09?
08,09 engine parts specs. are the same
it's just a paper smog cert issue? can one buy a 08 kit, install it
have someone else flash the ecm (not the dealer), who i dont know or device needed.
when the 09 kit comes out, reflash ecm back to stock 09,
since the hardware is already installed, take the car to the dealer flash to 09 kit , sell the 08 kit,
is this possible?
